Terms & Conditions
General
Unless the Company expressly states otherwise in writing, all quotations and accepted bookings are subject to these Terms and Conditions (the Conditions).
In these Conditions, “Company” means Acuity Training Ltd; “Contract” means any contract made subject to these Conditions; “Client” means any person who enters into such a Contract with the Company; and “Booking” means any confirmed reservation made with the Company, however it is made.
Other printed or standard conditions
These Conditions and the Contract form the entire understanding between the parties. They apply to the exclusion of all other contractual terms and conditions. Terms in any document sent by the Client have no effect on the Contract unless the Company expressly accepts them in writing.
The Client acknowledges that it has not relied on any representation, warranty, undertaking or statement that is not set out in these Conditions. The Client is not entitled to rescind the Contract, claim damages or seek any other remedy based on any such representation, warranty, undertaking or statement.
These Conditions may only be varied or waived with the Company’s express written agreement.
Prices
All prices are as stated and exclude VAT. Where applicable, VAT will be charged at the current rate.
Course cancellations and postponements
We offer as much flexibility as we commercially can when unexpected events arise. However, a booked place cannot be offered to someone else, so changes and cancellations must be limited.
Confirmed cancellations or postponements received by email or in writing more than 14 days before the course date incur an administration charge of £95.00 plus VAT or 10% of the course cost, whichever is greater.
Confirmed cancellations or postponements received by email, fax or in writing less than 14 days before the course date are payable in full.
Bookings made within 14 days of the course date incur a 100% cancellation charge if cancelled or postponed.
Private individuals must pay at the time of booking. We will contact you for payment when we receive your booking form.
Substitutes may attend at any time without penalty. Acuity should be informed of any changes.
Non-payment does not cancel a booking.
In line with statutory rights, private individuals booking for personal use have 14 days from booking to cancel without charge.
For private group training, no refund is available if an individual delegate’s place is cancelled or postponed at any time. Substitutes may attend at any time without penalty. Acuity should be informed of any changes prior to the training date.
Business customer payments
Unless otherwise agreed in writing, payment for each course must be received within 30 days of the invoice date. Non-payment does not cancel a booking.
BACS payments should be made to Acuity Training Ltd, account number 75052695, sort code 60-09-21, NatWest, 151 High Street, Guildford, Surrey, GU1 3AH.

Provision of service
The Company reserves the right to cancel, postpone, alter or delay any Booking.
Special needs
The Client is responsible for telling the Company about any delegates with special needs before booking. The Company cannot accept responsibility for those delegates unless it has confirmed in writing that it can accommodate their needs.
Scheduled courses
Trainers aim to deliver the modules in each scheduled course outline, but this is not guaranteed. On mixed ability courses, some delegates may find the pace and content unsuitable. Acuity aims to group delegates of similar ability, but the Client is responsible for checking that the course is at the right level for each delegate. Acuity accepts no responsibility if any part of the scheduled course outline is not covered.
We reserve the right to ask a delegate to leave if they do not have the prerequisite knowledge required for the course.
If you are the only delegate booked on a scheduled course, we reserve the right to halve its duration. For example, a two-day course becomes one day, and a one-day course becomes half a day. Alternatively, we will offer to transfer you to our next available course. The same situation may arise on that course, but we would not be able to transfer you again.
Holding accounts
All holding accounts expire no later than one year from the invoice date. Unused funds are non-refundable. Acuity accepts no responsibility for funds left unused within this period.
Consultancy
The Company supports its clients in the utmost good faith. However, because of the complexities of consultancy work, it accepts no liability and gives no guarantees for consultancy or associated work.
Recruitment
If, as a result of contact made while doing business with the Company, the Client recruits a member of the Company’s staff within one year of the last Booking, the Client must pay the Company compensation of 50% of that staff member’s final annual salary. This applies whether or not the staff member is still employed by the Company when recruited.
Invoicing details
Please tell us at the time of booking about any special invoicing requirements you have. The Client is responsible for ensuring that their invoice payment system does not delay payment.
